Premier Gym & Fitness Membership Terms & Conditions

1. INTRODUCTION
These Terms and Conditions (“Terms”) govern the membership agreement between the gym (“we”, “us”, “our”) and the member (“you”). By purchasing a membership, you agree to be bound by these Terms.
We offer different membership types as set out below. Please read these Terms carefully before joining.
KEY TERMS SUMMARY
Rolling Membership: monthly subscription billed on the anniversary of your join date
Fixed-Term Membership: 6 or 12 month prepaid membership (non-refundable unless stated otherwise in these Terms)
Billing Date: the anniversary of your membership start date (not calendar month)
Cancellation (Rolling): minimum 30 days’ notice, running to the end of a full billing cycle
Fixed-Term Cancellation: not cancellable once commenced except in limited circumstances
Price Changes: reviewed annually with at least 28 days’ notice
2. MEMBERSHIP TYPES
We offer two types of membership:
2.1 Rolling Monthly Membership
A Rolling Monthly Membership is an ongoing subscription which runs in successive monthly periods. Each monthly period begins on the anniversary of the membership start date and continues until the following monthly anniversary.
Rolling Memberships automatically renew each month unless cancelled in accordance with Section 6 (Cancellation).
2.2 Fixed-Term Memberships
Fixed-term memberships are prepaid memberships available for either 6 months or 12 months. These memberships begin on the date of purchase and run for the full duration selected.
Fixed-term memberships do not involve recurring monthly payments.
3. RELATIONSHIP BETWEEN MEMBERSHIP TYPES
Unless expressly stated otherwise, these Terms apply to both Rolling Monthly Memberships and Fixed-Term Memberships.
Where there is any conflict between provisions, the terms relating to Fixed-Term Memberships will take precedence for fixed-term members.
4. MEMBERSHIP COMMENCEMENT AND ACCESS
Your membership begins on the date of purchase unless otherwise agreed in writing.
Access to facilities is only permitted while your membership is active and in good standing.
5. PAYMENTS
5.1 Rolling Monthly Membership
Payments are taken monthly in advance via direct debit on the anniversary of your membership start date (the Billing Date). Each payment covers the upcoming monthly membership period.
If a payment fails, access may be suspended until payment is successfully collected.
5.2 Fixed-Term Memberships
Fixed-Term Memberships must be paid in full upfront at the point of purchase. No recurring payments apply.
You authorise us to collect monthly payments until your membership is properly cancelled in accordance with these Terms.

6A. COOLING-OFF PERIOD & MEMBER SATISFACTION GUARANTEE
All new members are entitled to a 14-day cancellation period starting from the date of membership purchase.
6A.1 Statutory Cooling-Off Rights (Online and Distance Sales)
If you join online or through any distance selling method (including telephone or website sign-up), you are entitled to a 14-day cooling-off period under the Consumer Contracts Regulations 2013.
During this period, you may cancel your membership and receive a refund, subject to any deduction for services already used if you requested immediate access to facilities.
6A.2 Member Satisfaction Guarantee (In-Club Sign-Ups)
For members who join in person at the gym, we offer a voluntary 14-day Member Satisfaction Guarantee.
During this period, you may cancel your membership and receive a refund if you are not satisfied, provided that the facilities have not been significantly used.
6A.3 Unified Application
Where applicable, this 14-day cancellation period reflects and includes your statutory rights. The most favourable right to the member will apply in all cases.
6. CANCELLATION – ROLLING MONTHLY MEMBERSHIP
You may cancel your Rolling Monthly Membership by giving at least 30 days’ notice.
Notice will take effect from your next Billing Date and will run for one full billing cycle.
Your membership will remain active and you will continue to have access to facilities until the end of that billing cycle.
You will remain liable for all payments due up to the end of the notice period and billing cycle.
7. CANCELLATION – FIXED-TERM MEMBERSHIP
Fixed-term memberships are non-cancellable and non-refundable once commenced.
Exceptions may be made at our discretion in cases including but not limited to:
Serious injury or medical incapacity
Permanent relocation beyond a reasonable commuting distance
Redundancy or similar exceptional financial hardship
Where an exception is approved, any refund will be calculated on a pro-rata basis, less any reasonable administrative costs.
8. MEMBERSHIP EXPIRY AND RENEWAL (FIXED-TERM)
Fixed-term memberships automatically expire at the end of the selected term (6 or 12 months).
They do not automatically renew.
If you wish to continue membership after expiry, you must purchase a new membership.
Renewal Terms (Fixed-Term Memberships)
At the end of a Fixed-Term Membership, any renewal will be offered at the prevailing membership rates applicable at that time.
Any renewal pricing may differ from the price paid during your initial membership term, including any promotional or discounted rates previously applied.
We may, at our discretion, offer renewal discounts from time to time, however these are not guaranteed and are subject to change.
9. PRICE CHANGES (ROLLING MEMBERSHIPS ONLY)
We may review membership fees once per year on 1 January.
Any increase will be capped at the lower of:
5% per year, or
the Consumer Price Index (CPI) published by the Office for National Statistics
We will provide at least 28 days’ written notice before any price change takes effect.
Price changes will not apply during an active Fixed-Term Membership.
10. FACILITY AND SERVICE CHANGES
We may make reasonable changes to facilities, equipment, opening hours, or class schedules from time to time.
Such changes will not materially reduce the core services provided.
11. MEMBER CONDUCT
Members must behave respectfully and follow all gym rules.
We reserve the right to suspend or terminate membership for:
Misuse of facilities
Disruptive or unsafe behaviour
Failure to comply with reasonable staff instructions
12. SUSPENSION OR TERMINATION BY US
We may suspend or terminate your membership if:
Payment is not received
You breach these Terms
Your behaviour adversely affects other members or staff
Where reasonable, we will provide notice before termination unless immediate action is required.
13. LIABILITY
We do not accept liability for loss, theft, or damage to personal belongings.
Nothing in these Terms limits liability where it would be unlawful to do so.
14. HEALTH AND SAFETY
You confirm that you are medically fit to participate in gym activities.
You are responsible for ensuring that you use equipment safely and appropriately.
We reserve the right to refuse entry to the gym or participation in classes where we reasonably believe it would be unsafe for you to take part. In such circumstances, you may be required to provide written confirmation from a qualified medical professional stating that you are fit to resume exercise before access is reinstated.
15. PERSONAL INFORMATION
We will process your personal data in accordance with applicable data protection laws.
Your data will only be used for purposes relating to your membership and legal obligations.
16. DISPUTE RESOLUTION
If you have a complaint, you should first raise it with a member of management, either in person or in writing.
We will acknowledge complaints within a reasonable timeframe and aim to resolve them internally within 14 days where possible.
If the matter cannot be resolved internally, it may be escalated to senior management for further review.
Where appropriate, we may offer mediation or alternative dispute resolution before any formal legal proceedings.
We are committed to handling disputes fairly, consistently, and in a timely manner.
17. GOVERNING LAW
These Terms are governed by the laws of England and Wales unless otherwise required by law.
18. CLASS BOOKINGS, CANCELLATIONS AND ATTENDANCE
18.1 Class Bookings
Class bookings open in advance of the scheduled class time (currently up to 14 days prior), however this may be amended from time to time at our discretion.
18.2 Cancellations and No Shows
Members are expected to cancel any booked class outside of the permitted cancellation window (currently up to 12 hours before the class start time). This timeframe may be updated from time to time.
Cancellations made within the permitted window, or failure to attend a booked class, will result in a strike being applied to your account.
If a member accumulates 3 strikes, booking privileges may be suspended for a period of up to 14 days.
18.3 Reformer Pilates & Hot Yoga Classes
Due to limited capacity, non-attendance for reformer Pilates and Hot Yoga classes will incur a charge (currently £10). This charge may be amended from time to time and will be communicated in advance where applicable.
18.4 Reasonable Adjustments
In certain circumstances, members can apply to have reasonable adjustments made to this cancellation window.
We reserve the right to apply discretion in exceptional circumstances (for example, illness or emergencies) to any cancellations.
19. UPGRADES, FREEZES AND MEMBERSHIP TRANSFERS
19.1 Upgrades and Downgrades (Rolling Monthly Memberships)
Rolling Monthly Members may upgrade their membership at any time. Any upgrade will take effect immediately or from the next billing date, depending on the selected option.
Downgrades may be requested at any time but will normally take effect from the next billing cycle.
19.2 Fixed-Term Membership Changes
Fixed-Term Memberships cannot be downgraded to a lower-value membership during the fixed term.
Members may request an upgrade to a higher-value membership during the fixed term. Any such upgrade may require payment of the difference in price, and the original fixed-term end date will remain unchanged unless otherwise agreed.
19.3 Membership Freezes
Rolling Monthly Memberships may be frozen at our discretion in cases such as medical reasons or exceptional circumstances. Freeze periods will pause access and may adjust future billing dates accordingly.
Fixed-Term Memberships may only be frozen in exceptional circumstances and, where approved, the membership term will be extended by the duration of the freeze period.
19.4 Transfers
Memberships are non-transferable unless expressly agreed in writing by us.
20. SERVICE AVAILABILITY AND INTERRUPTIONS
We will not be liable for any temporary closure of the gym or interruption to services where such interruption is caused by events beyond our reasonable control. This includes, but is not limited to, maintenance requirements, equipment failure, utility outages, public health restrictions, or emergency situations.
21. AGE RESTRICTIONS
Access to the gym and its facilities is restricted to individuals aged 16 and over. We reserve the right to request proof of age at any time.
22. DATA PROTECTION, PRIVACY AND CCTV
22.1 Data Controller
For the purposes of data protection law, Premier Gym & Fitness is the data controller responsible for your personal data.
22.2 How We Use Your Data
We collect and process your personal data to:
set up and manage your membership
process payments and prevent failed transactions
manage class bookings and attendance
provide access to the Club and its facilities
communicate with you regarding your membership and services
maintain the safety and security of members and staff
22.3 Legal Basis for Processing
We process your personal data in accordance with UK data protection law, including the UK General Data Protection Regulation (UK GDPR), on the following bases:
Contractual necessity – to fulfil your membership agreement
Legal obligation – to comply with applicable laws
Legitimate interests – to operate and improve our services and ensure safety
Consent – where required (e.g. marketing communications)
22.4 Sharing Your Data
We may share your data with trusted third-party providers strictly where necessary to operate the Club, including:
membership management systems (e.g. Glofox)
payment processors (e.g. GoCardless)
access control systems (e.g. Kisi)
All third parties are required to process your data securely and in accordance with data protection law.
22.5 Marketing Communications
We may send you updates, offers and relevant information about our services.
You can opt out of marketing communications at any time by following the unsubscribe instructions or contacting us.
22.6 Data Security
We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, misuse or disclosure.
22.7 Data Retention
We will retain your personal data only for as long as necessary to fulfil the purposes outlined in this agreement, including legal, accounting and reporting requirements.
22.8 Your Rights
Under data protection law, you have the right to:
access your personal data
correct inaccurate or incomplete data
request deletion of your data where applicable
restrict or object to processing
withdraw consent (where processing is based on consent)

22.9 CCTV and Security Monitoring
CCTV is in operation throughout parts of the Club for the purposes of:
ensuring the safety and security of members, staff and visitors
preventing and detecting crime or misconduct
supporting incident investigations
CCTV footage is processed in accordance with data protection law and will only be accessed by authorised personnel. Footage may be shared with law enforcement or insurers where required.
22.10 Privacy Policy

23. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and us in relation to your membership and supersede any prior discussions or understandings.
